A person was fully released from criminal liability thanks to the efforts of Ketevan Talakvadze, an attorney at the Mtskheta Legal Aid Bureau.
According to the court ruling, attorney Ketevan Talakvadze, under Article 238, Part 3 of the Criminal Code, Article 260, Part 3 of the Criminal Code, and Article 273 of the Criminal Code, became involved in the case of G.G. , the accused, when a plea agreement was to be signed against the accused.
G.G. had deposited 5,000 GEL as bail. As a result of the plea agreement, he would have been sentenced to a 5-year suspended sentence and a number of his rights would have been restricted for a long time.
The defence requested that the cases be merged. The attorney relied on the amendments to the Law "On Narcotic Drugs, Psychotropic Substances, Precursors and Narcotic Aid", which came into effect on March 5, 2021, according to which the quantities of narcotic drugs and psychotropic substances were changed; K.Talakvadze appealed to the Tbilisi Court of Appeal, and instead of a guilty verdict, an acquittal was rendered. Accordingly, the prosecution no longer had grounds to prosecute G.G. under the charges.
Based on the evidence presented by attorney Ketevan Talakvadze, the prosecution dropped part of the charges, while part of the allegations were mitigated; and, based on the "amnesty laws", G.G. was fully released from criminal liability.
